FILING REQUIREMENTS
Application shall contain:
? The request for registration of the trademark.
? Information about the applicant.
? The mark for which protection is requested (The appearance of the sign shall be made in such a way that it can fit in a square with a side length 80 mm; the distance between the two farthest points on the sign -horizontally, vertically or in diameter- cannot be less than 15 mm).
? A list of goods or services for which registration is sought, classified according to the
? International Classification of Goods and Services (the Nice Agreement Concerning the
? International Classification of Goods and Services for registration of marks).
? Proof of payment of the administrative fee.
? Authorization (Power of Attorney), if the application is filed through a representative.
The following documents may be filed subsequently:
The Power of Attorney, which should be duly signed by the applicant. No notarization or legalization is required. The original Power of Attorney however is required. The Power of Attorney can be submitted either together with the application or subsequently, but no later than upon the invitation of the Montenegro IP Office.
For applications claiming priority, the Montenegro application must be submitted within 6 months as of the filing date of the priority application. (A certified copy of the priority document accompanied with its translation must be submitted either together with the application or subsequently no later than upon the invitation of the Montenegro IP Office.)
PROCEDURE
Upon filing a new application with the IP Office of Montenegro, the Office assigns the application number. If all formal elements of filing are satisfied, as well as absolute grounds for rejection are examined and found in compliance with the Trademark Law, the trademark application is published in the IP Gazette. In case nobody opposes the published application within 90 days from the publication date, the Office requests the applicant to pay the registration fees for the first 10 years of validity.
After the payment of the fees, the Office registers the trademark in the Registry and issues an Official Decision on Registration. On the basis of this Decision the trademark is granted and the applicant can then request the official Certificate of Trademark Registration. According to the practice of the Montenegrian IP Office, the Certificate is “optional”, meaning that the applicant is not obliged to request the Certificate.
A trademark is valid for ten years from the date of filing.
A trademark can be renewed an unlimited number of times for a period of 10 years, provided that before the expiry of the ten-year period, the holder of the trademark files an application for renewal of a trademark and submit proof of payment of administrative fees.
An application for renewal of a trademark can be filed within six months after the expiry of the period provided that prescribed administrative fee (increased for 50%) is paid.
